Better late than never! California’s directed trust statute went into effect on January 1, 2024 and as we’ve already seen in other jurisdictions, it is a valuable estate planning tool that allows us to meet client goals by giving us the ability to customize trust management. In a directed trust, a trustee’s duties are shared with appointed “directors” who direct the trustee with respect to particular assets or responsibilities which would traditionally fall entirely under the purview of the trustee. Importantly, the trustee can be shielded from liability for acting on those directions. This CLE will go over the basics of the new directed trust statute and discuss when using this type of trust would provide the most value to clients.
